1. Acceptance
By accessing or using postibo.com ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Postibo provides AI-driven content automation features, including blog post generation, landing page generation, product descriptions, image generation, social media posting, and publishing integrations with third-party CMS platforms.
3. Account
You are responsible for maintaining the confidentiality of your account credentials and API tokens, and for all activity under your account. Notify us immediately of any unauthorized use.
4. Acceptable use
You may not use the Service to:
- Generate content that infringes intellectual property, defames individuals, or incites violence.
- Generate illegal content including CSAM, content that violates export controls, or content prohibited by local law.
- Attempt to reverse-engineer the Service or bypass security controls.
- Abuse credits, bypass rate limits, or interfere with other users' access.
- Spam or harvest email addresses from the Service.
5. Content ownership
You retain ownership of the content you submit (prompts, references, uploads). You own the output generated from your prompts, subject to any third-party rights in the underlying models and reference material. You grant Postibo a license to process your content solely to deliver the Service.
6. AI-generated content disclaimers
The Service uses third-party AI models to generate content. Output may be inaccurate, biased, or offensive. You are solely responsible for reviewing content before publishing. Postibo makes no guarantees of accuracy, novelty, or fitness for purpose.
7. Third-party services
When you connect a CMS (WordPress, Shopify, Ghost, Webflow, Wix), a social media account, or a payment method, you also agree to the applicable third-party terms of those platforms. Postibo is not responsible for third-party service failures.
8. Credits and billing
Features meter against a credit balance. Credits expire per the schedule shown at purchase. We may modify pricing and credit allocations with 30 days' notice. Billing is processed by a third-party payment provider; we do not see, store, or process card numbers. All sales final except where required by law.
9. Service availability
We aim for high availability but provide no uptime guarantees during early access. We may modify, suspend, or terminate features at any time. Scheduled maintenance announced in advance when possible.
10. Data
Your data handling is covered by our Privacy Policy. You can export your data at any time. Account deletion purges personal data within 90 days, subject to retention obligations.
11. Intellectual property
Postibo's software, trademarks, and branding are owned by us. You receive a limited, non-transferable license to use the Service for the term of your account.
12. Termination
You may terminate your account at any time. We may terminate your account for breach of these Terms, misuse of the Service, or at our discretion with reasonable notice.
13. Warranties and disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTIBO'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE TWELVE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
15. Indemnification
You agree to indemnify Postibo against claims arising from your use of the Service, your generated content, or your violation of these Terms.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which Postibo is incorporated, without regard to conflict-of-law rules. Disputes resolved in the courts of that jurisdiction unless otherwise required by applicable consumer protection law.
17. Changes
We may update these Terms. Material changes notified by email. Continued use after changes indicates acceptance.
